Terms of Service

Effective September 21, 2026

These Terms of Service (the "Terms") govern your access to and use of the Homeplate website, applications, meal plans, recipes, grocery lists, emails, and related services (collectively, the "Service"). In these Terms, "Homeplate," "we," "us," and "our" refer to the operator of the Service.

By creating an account, clicking to accept these Terms, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who may use Homeplate

Homeplate is intended for users in the United States who are at least 18 years old. You may use the Service only if you can form a binding contract with Homeplate and are not barred from using the Service under applicable law. You are responsible for ensuring that information you provide about yourself and members of your household is accurate and that you have authority to provide it.

Your account and communications

You are responsible for safeguarding your account and for activity occurring through it. Promptly notify us at hello.homeplate@gmail.com if you believe your account has been accessed without authorization.

You agree that we may send you service-related messages, including verification, security, account, plan, and grocery-list emails. You can manage optional marketing emails in Account Settings or by using the unsubscribe link in those emails. Opting out of marketing does not stop essential service-related communications.

The Service and AI-generated content

Homeplate helps you create and organize personalized meal plans, recipes, and grocery lists. It uses automated systems, including artificial intelligence, to generate or revise some content based on information you provide and the preferences saved to your account.

AI-generated content can be incomplete, inaccurate, unsuitable for your circumstances, or unavailable. You are responsible for reviewing plans, recipes, ingredient quantities, nutrition-related information, substitutions, and grocery lists before relying on them. Do not treat generated content as professional medical, nutritional, dietary, legal, or other professional advice.

Homeplate does not provide medical care, diagnose conditions, prescribe treatment, or create a clinician-supervised diet. Consult an appropriately qualified healthcare professional, registered dietitian, or other professional before acting on content when you have a medical condition, dietary restriction, pregnancy, eating disorder, medication interaction, or other health concern.

Food safety, allergies, and dietary restrictions

Homeplate may use dietary preferences and instructions you provide, but it cannot guarantee that a recipe, ingredient, substitute, grocery item, or prepared meal is free of allergens, dietary conflicts, contamination, or cross-contact. We do not inspect food products, verify manufacturer labeling, control restaurants or grocery providers, or prepare food.

You are solely responsible for checking current product labels, ingredient lists, allergen statements, and manufacturer information; selecting safe ingredients; preventing cross-contact; and using safe food handling and cooking practices. Do not rely on Homeplate as the sole source of information for managing a food allergy, intolerance, or medical condition. If you have a severe allergy or any concern about a food, consult an appropriate professional and follow the advice of your healthcare team.

Your content and feedback

You may submit prompts, preferences, household information, recipe edits, ratings, and other materials to the Service ("Your Content"). You retain any ownership rights you have in Your Content.

You represent that you have the rights, permissions, and authority needed to submit Your Content and grant the license below.

You grant Homeplate a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, analyze, adapt, modify, create derivative works from, and otherwise use Your Content to operate, secure, maintain, personalize, improve, and develop the Service and related content. Homeplate may use and distribute derivative, aggregated, de-identified, or generalized material created from Your Content. We will not publicly share Your Content as submitted or identify you as its source without your consent.

This license continues after Your Content is deleted from our active systems only for derivative, aggregated, de-identified, or generalized material that does not identify you or reasonably identify a member of your household, and for content retained in backups or as reasonably necessary for legal, security, fraud-prevention, or operational purposes. Nothing in this section permits us to use or disclose personal information or consumer health data beyond what is described in our Privacy Policy and Consumer Health Data Privacy Policy.

As between you and Homeplate, you may use generated meal plans, recipes, and grocery lists for your personal, lawful purposes. Homeplate may reuse, adapt, create derivatives from, and incorporate generated content into the Service and related content, but will not publicly share your generated content as submitted or identify you as its source without your consent. Homeplate does not promise that generated content is unique, accurate, non-infringing, or available for every use. Similar content may be generated for other users, and you remain responsible for reviewing it before sharing or using it.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation to you.

Acceptable use

You may not, and may not help another person to:

  • use the Service unlawfully or infringe another person’s rights;
  • submit content that is fraudulent, harmful, threatening, abusive, or deceptive;
  • access another user’s account or interfere with the Service, its security, or its availability;
  • probe, scan, or test the vulnerability of the Service without our written permission;
  • copy, modify, reverse engineer, decompile, scrape, or create derivative works from the Service except where applicable law does not allow this restriction;
  • use automated means to access or collect information from the Service without our written permission; or
  • use the Service or its output to develop, train, or improve a competing service or model, except where applicable law does not allow this restriction.

We may investigate suspected violations and suspend or terminate access as described below.

Homeplate’s intellectual property

Homeplate and its licensors own the Service, including its software, branding, visual design, and underlying content, excluding Your Content. Subject to these Terms, we give you a limited, personal, non-transferable, non-sublicensable, revocable right to use the Service for its intended purpose.

Privacy and consumer health data

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we collect, use, disclose, and retain personal information and consumer health data. They are part of these Terms. If these Terms conflict with either policy on the handling of that data, the applicable policy controls.

Third-party services

The Service may contain links to, or allow you to interact with, third-party services. Those services are governed by their own terms and privacy policies. Homeplate is not responsible for third-party services, content, availability, products, or practices. If we offer an integration, we will identify the recipient and the information to be shared before you ask us to initiate it.

Changes, availability, and account termination

We may modify, suspend, or discontinue all or part of the Service, including features, at any time. We may suspend or terminate your account if we reasonably believe you violated these Terms, created risk or possible legal exposure for Homeplate or others, or used the Service in a way that harms the Service or other users.

You may stop using the Service and request account deletion at any time through the Service or by contacting us. If you use the in-product account-deletion process, your account is deactivated and may be recovered by logging in within the stated 30-day recovery period. After that period, we will process permanent deletion in accordance with our Privacy Policy, subject to information that must be retained for legitimate legal, security, fraud-prevention, backup, or operational reasons.

Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEPLATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Homeplate does not warrant that the Service will meet your needs; that generated content will be correct, safe, complete, current, or suitable; or that it will identify every allergen, dietary conflict, nutritional consideration, or food-safety issue.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEPLATE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEPLATE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID HOMEPLATE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Homeplate and its owners, officers, employees, contractors, licensors, and service providers from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or applicable law.

Changes to these Terms

We may update these Terms as the Service changes. We will post the updated Terms with a new effective date. If a change is material, we will provide additional notice when required by law. By continuing to use the Service after the effective date, you agree to the updated Terms. If you do not agree, you must stop using the Service.

General terms

These Terms, together with the Privacy Policy and Consumer Health Data Privacy Policy, are the entire agreement between you and Homeplate about the Service. If any provision is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Homeplate may assign them in connection with a merger, acquisition, reorganization, or sale of assets. Sections that by their nature should survive termination will survive, including sections above concerning content, intellectual property, termination, disclaimers, limitation of liability, indemnity, and general terms.
